Lower Gwynedd Township is writing a data center ordinance and held a public meeting on it on Oct. 6, 2026. The township says no data center is proposed there.

⚖️ Court case · Upper Merion Township

After Upper Merion supervisors rejected its data center plans, the developer sued the township in Montgomery County court. It asks a judge to reverse the denial, grant preliminary approval and appoint an outside referee. Its lawyer says the township first called data centers a permitted use, then changed course after public opposition.

Upper Merion supervisors unanimously rejected five land development plans for a data center campus of more than 4.5 million square feet in King of Prussia. They said the plans lacked key details, including on fire safety, and did not meet zoning rules. They also denied the developer's requests for more time.

A developer is asking the Plymouth Township Zoning Hearing Board for a special exception to turn the closed Cleveland-Cliffs steel mill on Conshohocken Road into a 2 million-square-foot AI data center. An earlier request was withdrawn in November 2025 over a legal standing problem. Hearings on the new request began in summer 2026 with no decision yet.

📜 Data center rules · Towamencin Township

Towamencin supervisors held a public hearing on rules for data centers and considered Ordinance 26-04. Later township records describe data centers as limited to the amended Light Industrial zone, with a minimum size so large that no single property qualifies without combining lots.

A developer asked Limerick Township for a conditional use approval to build a 1.4 million-square-foot data center campus on about 192 acres across from the Philadelphia Premium Outlets. The township planning commission listed 18 conditions it wants met, such as noise testing and proof of water supply. The supervisors' hearing began in April 2026.

The Montgomery County Planning Commission helped write the joint Data Center Ordinance Guide with Chester County. It gives towns sample rules, such as a 1,000-foot buffer from homes, a 60-foot height limit and night noise limits.
