Residents asked the district court to review and cancel the county's permits for the Prometheus data center. They said there were secret meetings and conflicts of interest, and that a water study was needed. The county denied this. A judge dismissed the case on Aug. 17, 2026, so the permits stand.

County commissioners unanimously granted a conditional use permit for Prometheus Hyperscale's 1.25-gigawatt data center on about 506 acres east of Evanston. The permit has about 30 conditions, including dust and noise limits, closed-loop cooling, and protecting local electric rates.
