    NP Hazleton Holdings 1 LLC applied to the Susquehanna River Basin Commission (SRBC) for approval of water use by the data center (Pending No. 2025-149). As of October 2026 it is still listed as pending.

    Supervisors denied land development approval.

    At a state DEP hearing, the developer said cooling water would be treated wastewater from the Greater Hazleton Joint Sewer Authority, up to 2.8 million gallons for all 15 buildings, and that it would pay for the pipeline and plant upgrades. Residents asked how much would evaporate.

    Luzerne County judge denied the developer's appeal; township declared its zoning invalid on data centers and started a 180-day pause to write rules.

Hazle Township supervisors unanimously declared parts of the township's zoning invalid because it does not cover data centers. This starts a pause of about 180 days on new data center applications while the planning commission writes new rules.

A Luzerne County judge denied the Project Hazelnut developer's appeal of the township's rejection. The judge said the project should first go to the township zoning board for a special exception. The developer is now asking a state appeals court to review it.
