Local votes and rules
βοΈ Court case
Boulder City Council voted unanimously to appeal the federal Bureau of Land Management's approval of the Townsite Solar 2 data center on BLM land and to ask for a stay. The city says the BLM skipped required steps. In early September 2026 an administrative judge granted the stay, so the project is paused for now.
π Other Β· Clark County
Clark County commissioners heard calls for a pause on data centers but took no action. They asked county staff to study how data centers affect county services and the county's land use code (Title 30). There is no moratorium in unincorporated Clark County.
β Approved Β· Clark County
Clark County commissioners, sitting as the zoning board, unanimously approved a 56,800-square-foot Switch data center on about 9 acres near Warm Springs Road, next to Switch's existing campus. Switch agreed to plant trees, pay for a sidewalk barrier, and use a closed-loop water system using under 1,000 gallons of public water a day.
β Turned down
Boulder City's Planning Commission voted to recommend that the City Council deny Townsite Solar 2's request to build an AI data center on city-owned land in the Eldorado Valley. In July the developer withdrew its city request and moved the project onto federal (BLM) land next door.
π³οΈ Public vote
Boulder City Council put a question on the November 3, 2026 ballot: should data centers be an allowed land use in the Eldorado Valley Transfer Area (outside the habitat conservation easement)? The city charter requires voters to approve new uses there. A yes vote would allow, but not require, the council to approve data centers. A separate citizen petition for a data center initiative fell short of signatures.
