The New Mexico Environmental Law Center sued the County Commission for a community group and residents. It says the county approved the Project Jupiter bonds based on an incomplete application with blank pages. On March 20, 2026, a judge refused to throw out the case but also refused to pause the ordinances, so building goes on. The court will review the county's Sept. 19 and Oct. 14, 2025 actions.

County commissioners voted 4-1 for three ordinances for Project Jupiter in Santa Teresa: tax-break bonds (industrial revenue bonds) of up to $165 billion, and two local economic development (LEDA) funding ordinances. The bond deal was made public only days before the vote, and public comment lasted over four hours. The vote is being challenged in court.
